By accessing or using BookDesk ("Service"), you agree to be bound by these Terms of Service. If you do not agree to all of these terms, do not use the Service. These Terms apply to all visitors, users, and others who access or use the Service.
2. Description of Service
BookDesk is an appointment scheduling platform that enables service businesses to manage bookings online. The Service includes:

- ● SMS communication for appointment management
- ● AI-powered chat assistance
- ● Customer portals for managing appointments
- ● Payment processing for services
3. User Accounts
- ● Business accounts: Service providers create accounts to manage their booking operations
- ● Customer interactions: End customers interact with businesses through BookDesk's booking pages, SMS, and chat
- ● You are responsible for maintaining the security of your account credentials
- ● You must provide accurate and complete information
4. SMS/Text Messaging Terms
By providing your phone number and consenting to receive messages, you agree to the following SMS/text messaging terms.
- ● Program Name: BookDesk Appointment Messaging
- ● Program Description: Appointment confirmations, reminders, verification codes, scheduling updates, and conversational booking assistance sent on behalf of service businesses to their customers
- ● Message Frequency: Message frequency varies based on appointment activity. Typically 2–5 messages per appointment (confirmation, reminder, follow-up)
- ● Message and Data Rates: Message and data rates may apply. Contact your wireless carrier for details about your messaging plan
- ● Opt-In: By providing your phone number during the booking process and checking the consent checkbox, or by texting a business's phone number, you consent to receive appointment-related text messages
- ● Opt-Out: Reply STOP to any message to opt out of all future text messages. You will receive a confirmation message. You can opt back in by texting the business number again
- ● Help: Reply HELP to any message for assistance, or contact us at spencer@bookdesk.ai
- ● Supported Carriers: Major US carriers are supported including AT&T, Verizon, T-Mobile, Sprint, and others. Carriers are not liable for delayed or undelivered messages
- ● Privacy: See our Privacy Policy for details on how we handle your information. We will never share or sell your mobile information to third parties for marketing purposes
5. Appointment Booking
- ● Bookings are subject to availability and the policies of the individual business
- ● Cancellation and rescheduling policies are set by each business
- ● Deposits and cancellation fees, if applicable, are determined by each business
6. Payments
- ● Payments are processed securely through Stripe
- ● BookDesk does not store credit card numbers
- ● Refund policies are determined by each business
- ● BookDesk charges businesses a platform subscription fee; end customers are not charged by BookDesk
7. Acceptable Use
You agree not to:
- ● Use the Service for any unlawful purpose
- ● Send spam, unsolicited messages, or abusive content
- ● Attempt to gain unauthorized access to any part of the Service
- ● Interfere with or disrupt the Service
- ● Impersonate any person or entity
8. Intellectual Property
All content, features, and functionality of BookDesk are owned by BookDesk and are protected by copyright, trademark, and other intellectual property laws. You may not copy, modify, distribute, or create derivative works based on our Service without express written permission.
9. Limitation of Liability
BookDesk is provided "as is" without warranties of any kind, whether express or implied. To the fullest extent permitted by law, BookDesk shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or goodwill, arising from your use of or inability to use the Service.
10. Indemnification
You agree to indemnify and hold harmless BookDesk, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including attorney's fees) arising from your use of the Service or your violation of these Terms.
11. Termination
We may terminate or suspend your access to the Service at any time, without prior notice, for conduct that we believe violates these Terms or is harmful to other users or the Service. Upon termination, your right to use the Service will immediately cease.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Utah, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts located in the State of Utah.
13. Changes to Terms
We reserve the right to modify these Terms at any time. Material changes will be posted on this page with an updated "Last updated" date. Your continued use of the Service after any changes constitutes your acceptance of the revised Terms.
